Terms of Use

1. License Grant

CogZero, Inc. grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App for your personal, non-commercial use on iPhone or iPad devices that you own or control, strictly in accordance with these Terms and the Apple App Store Terms of Service.

2. Ownership & Intellectual Property

The App, including all text, graphics, I Ching translations, educational content, design, software, and trademarks, is owned by CogZero, Inc. or its licensors and is protected by copyright, trademark, and other laws. You are granted no rights beyond the limited license in Section 1.

3. Acceptable Use

You may use Jing Journal only for lawful, personal, reflective, and mindfulness purposes. You agree not to:

• Use the App for any commercial purpose
• Copy, modify, distribute, reverse-engineer, or create derivative works of the App
• Remove or alter any copyright, trademark, or other proprietary notices
• Use the App in any way that violates applicable laws or regulations

4. AI-Generated Content & “Advice”

The personalized insights in the “Insight” tab are generated by artificial intelligence (Google Gemini via Vertex AI) based on your question and traditional I Ching principles.

These insights are for entertainment, reflection, and personal-growth purposes only. They are not professional medical, psychological, financial, legal, or any other form of regulated advice. You should not rely on them for decisions that require qualified professional guidance.

You are solely responsible for how you interpret and act on any content provided by the App.

5. In-App Purchases & Credits

• Credit packs are non-refundable (except where required by law) and are processed through the Apple App Store.
• Credits are used to unlock personalized AI insights (1 credit = 1 insight).
• Unused credits do not expire as long as the App remains available on the App Store.
• Prices are shown in the App and may change; any price change will not affect purchases already made.

6. Availability & Updates

We may update the App from time to time. Some updates may be required for continued use. We may also discontinue or modify features without prior notice, though we will make reasonable efforts to maintain core functionality.

7. Termination

You can stop using the App and delete it at any time. We may terminate or suspend your access to the App immediately, without notice, if you breach these Terms or if we discontinue the App.

8. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that the App will always function without disruptions, delays, or errors.

9. Limitation of Liability

To the maximum extent permitted by law, CogZero, Inc. and its officers, employees, or agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, even if advised of the possibility of such damages.

Our total liability to you for all claims arising from the App will not exceed the amount you paid us in the 12 months prior to the claim (or $5 USD if you made no payments).

10. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

11. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted here and, if material, notified inside the App. Your continued use of the App after changes constitutes acceptance of the new Terms.
